11. Two scopes of this policy

This policy covers (i) the website forms and browsing and (ii) the account and use of the FalaAI API.

12. How the API handles content (Zero-Storage)

FalaAI API does not retain the submitted content (audio, text or result), which is processed and discarded; it keeps only usage, log and audit records, with no content or client data.

13. What is retained

FalaAI API keeps, without conversation content: (i) account registration data (for example, name and email); (ii) usage records per API call (endpoint, date and time, duration, credits and costs, technical metadata); (iii) financial records (invoices, transactions and receipts); and (iv) security and audit records.

14. Retention

Website forms: up to 2 years. Account: while active and, after termination, only for the applicable periods. Financial records: for the applicable legal and tax period (reference: up to 5 years). Usage and security records: for the period necessary for operation, auditing and defense. Conversations, transcriptions and analyses processed in FalaAI (platform) are stored and kept for the retention period of the plan in force at the time of purchase, in accordance with the applicable commercial conditions; once the period ends, the data is deleted. Audio files are client input, disposable at any time.

15. Roles: controller and processor

For the data of conversations processed by the API, the client is the controller (decides the purpose and legal basis, including as to the data subjects appearing in the conversations) and Action Tec Brasil acts as processor (FalaAI and FalaAI API are products), handling the data only according to the client's instructions and to perform the service.

16. Sharing and sub-processors

We do not sell personal data. We share data with providers necessary to perform the service (hosting, infrastructure and AI providers that process the content exclusively to generate the result), under protection obligations and without storing content, in addition to legal grounds and court orders.

17. Communications and marketing

Operational communications (account, security and billing) are sent regardless of consent. Marketing communications (promotions and new features) depend on optional consent, revocable at any time through a setting in the account and an unsubscribe link in every message.

18. Your rights and how to exercise them

You may exercise your data subject rights via contato_falaai@action.tec.br, with a response period of up to 15 calendar days (art. 19 of the LGPD). The data protection officer (DPO) and WhatsApp are provided in this policy, and you may also file a complaint with the ANPD.

19. Data deletion and fraud prevention

Conversation data sent to FalaAI API is not retained; deletion requests and retention grounds (fraud prevention and legal/tax obligations) follow the LGPD Policy.
